Terms of Service

The terms that govern your use of Scout.

Effective Date: July 30, 2026

Welcome to Scout. These Terms of Service ("Terms") are a binding agreement between you and Scout a Dog Park, LLC ("Scout," "we," "us," or "our") and govern your access to and use of the Scout mobile application, our website at scoutadogpark.com, and any related features, content, and services we provide (together, the "Service").

By creating an account, or by accessing or using the Service in any way, you agree to these Terms. If you do not agree, do not access or use the Service.

These Terms incorporate our Privacy Policy, which explains how we collect and use your information, and any additional policies, rules, or guidelines we post for specific features ("Additional Terms"), which are incorporated by reference.

PLEASE READ CAREFULLY. These Terms include an arbitration agreement and a class action waiver (see "Dispute resolution; arbitration and class action waiver"), disclaimers of warranties, and limitations of our liability. They affect your legal rights.

ARBITRATION NOTICE. Except for certain disputes described in the "Dispute resolution; arbitration and class action waiver" section, you and we agree that disputes between us will be resolved by binding individual arbitration, and you waive your right to participate in a class action or class-wide arbitration.

1. Changes to these Terms

We may update these Terms from time to time. If we make changes, we will update the effective date above and, for material changes, provide notice through the Service, by email, or by other reasonable means. Changes take effect when posted unless we state otherwise. If you continue to use the Service after changes take effect, you agree to the updated Terms. If you do not agree, you must stop using the Service.

2. Eligibility and age

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent that you are 18 or older, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under any applicable law.

3. Your account and dog profiles

To use most features, you must create an account and provide accurate, current, and complete information, and you are responsible for keeping it up to date. You may sign in using a third-party account (such as Apple or Google), in which case you authorize us to access certain information from that account as described in our Privacy Policy.

You are responsible for the accuracy of your account and of any dog profile you create. For each dog you add, you represent and certify that you are the dog's owner or that you have the owner's permission to create a profile for that dog and to check the dog in at a dog park through the Service. You may not create a profile for a dog you do not own without the owner's authorization.

You are responsible for safeguarding your credentials and for all activity under your account. Do not share your account or credentials, and do not use another person's account or impersonate any person or dog. Notify us promptly at admin@scoutadogpark.com if you suspect unauthorized use of your account. You may not transfer your account to anyone without our prior written consent.

4. The Service

Scout is a location-based social networking app for dog owners. Among other things, it lets you create a personal account and a separate profile for each of your dogs; discover dog parks near you and view and contribute information about them, including reviews and reports (such as flagging a small-dog run or a missing or temporarily closed park); check in when you arrive at a park and keep visit streaks; connect with other users as friends; message friends one-on-one or in groups; schedule park visits and view weather forecasts for them; and receive notifications you enable, including friend and check-in alerts and reminders based on your own visit patterns.

Information shown for a given park may be provided by us, by third parties, or by other users, and may be incomplete, out of date, or inaccurate. We do not independently verify user-contributed information, and we do not manage, operate, or inspect the parks listed in the Service. You are responsible for evaluating, and bear the risks of relying on, any park information or other content.

Connecting with other users. You can add friends by searching, by scanning a QR code, or — if you enable it — through phone-number matching, which suggests other users who have your number saved in their contacts and who have verified their own number. The Service does not let other users discover you based on your real-time location. If you use contact matching, you consent to the Service accessing your device contacts for that purpose and represent that you have any permission needed to do so.

We may change, suspend, or discontinue any part of the Service at any time, and may impose limits on features or restrict access, with or without notice. We will try to provide notice of material changes that adversely affect you where practical.

5. Location information

Scout uses your device's location to find dog parks near you and invites you to check in when you arrive at a park. If you turn on arrival and departure reminders, Scout uses background ("Always") location to detect when you enter and leave a park; it does not continuously track or store a history of your movements outside of that. You can enable or disable location access, and choose between "While Using the App" and "Always," in your device settings; if you disable it, related features may not work or may be limited. The Service does not use your location to reveal your real-time whereabouts to other users.

Location technology is not always accurate, and we are not responsible for the accuracy of location data or for any consequences of location-based features. How we collect, use, and share location information is described in our Privacy Policy.

6. User content and licenses

Your content. Anything you post, upload, submit, share, store, or otherwise make available through the Service is your "User Content." This may include profile information, dog profiles, photos, reviews, ratings, park reports, comments, messages, and check-ins. You are solely responsible for your User Content, and some User Content may be visible to other users depending on the feature and your settings.

Your responsibilities and representations. You represent and warrant that (a) you own or have all rights, licenses, consents, and permissions necessary to your User Content and to grant the licenses below; (b) your User Content, and our and other users' use of it as permitted here, does not and will not infringe or violate the rights of any third party (including intellectual property, privacy, and publicity rights) or any law; and (c) you have the consent of every identifiable person appearing in your User Content to include them.

License to us. You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to host, store, use, reproduce, modify, adapt, translate, publish, publicly display and perform, and distribute your User Content in connection with operating, providing, improving, and promoting the Service — for example, showing your dog's check-in photo to your friends. This license continues for content you have shared until it is deleted from our systems and backups in the ordinary course, and survives to the extent needed for legitimate business or legal purposes.

License to other users. You also grant each other user of the Service a non-exclusive license to access and use your User Content as permitted by the features of the Service and your settings.

Feedback. If you send us suggestions, ideas, or other feedback about the Service, we may use it without restriction and without any obligation to you.

7. Rules of conduct

You agree not to use the Service to, and not to post or contribute User Content that:

We may investigate and take action against violations, including removing content, restricting features, and suspending or terminating accounts, and reporting to law enforcement.

8. Interactions, safety, and assumption of risk

The Service lets you connect and interact with other users you find through search, QR code, or contact matching, and it centers on real-world locations, such as dog parks, that you and other users may choose to visit in person. You are solely responsible for your interactions with other users and dogs whether online or in person. We are not a party to any arrangements or meetups you make with other users, we do not conduct background checks or verify the identity, statements, or conduct of users or dogs, and we make no representations or warranties about any user or dog or about any park.

Use good judgment and take reasonable safety precautions in all interactions, particularly any that take place in person or at a physical location. You acknowledge that meeting other people and dogs and visiting dog parks carry inherent risks — including the risk of illness, bodily injury, disability, or death, and risks associated with animals and other people's pets — and you freely choose to assume those risks, for yourself and your dog.

To the fullest extent permitted by law, you release Scout a Dog Park, LLC and its officers, directors, employees, and agents from all claims, demands, and damages (direct or consequential) arising out of or connected with your interactions with other users, your travel to or from any location, your or your dog's presence at any location, or the conduct of any user or animal at any location. If you have a dispute with another user, you release us from all claims arising out of it. Some jurisdictions do not allow such releases, so this may not apply to you.

9. Content moderation and removal

We may, but are not obligated to, monitor, review, or moderate User Content. We may remove or disable access to any content, and restrict features, suspend, or terminate any account, at our discretion and without notice, including content we believe violates these Terms or that is otherwise objectionable, or when we believe doing so is necessary to comply with law or protect the Service or others.

10. Copyright and DMCA policy

We respect intellectual property rights and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).

If you believe content on the Service infringes your copyright, please send a written notice to our designated agent that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and information sufficient for us to locate it; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf.

We may remove or disable allegedly infringing material, notify the person who posted it, and terminate repeat infringers' accounts. If you believe your content was removed by mistake or misidentification, you may submit a counter-notice with the information required by the DMCA, and we will follow the DMCA's counter-notice procedures.

11. Communications and verification

When you create an account, we verify your contact information — you sign up with a phone number or an email address, and we may send a verification code or link to it that you enter or confirm to complete signup. By providing your contact information, you consent to receive these verification messages and other messages related to your account and the Service (such as security alerts and important service notices). Message and data rates may apply, and message frequency varies.

Where you have consented, we may also send you promotional messages. You can opt out of promotional messages at any time — reply STOP to promotional texts or use the unsubscribe link in emails. Verification, security, and other essential service messages are necessary to use the Service and cannot be opted out of while you maintain an account. You can control push notifications, and turn individual notification types on or off, in your device and in-app settings. You represent that you are authorized to receive messages at the contact information you provide. We are not liable for delays or failures in delivery by your carrier or provider.

12. Paid features

The Service is currently free. We may offer paid features or subscriptions in the future ("Paid Services") and will present the applicable pricing and payment terms before you purchase. Payments are processed by third-party processors (including the Apple App Store for in-app purchases), and are subject to their terms. Subscriptions may renew automatically unless canceled through your app store subscription settings before the renewal date. Except as required by law or the applicable app store's policies, fees are non-refundable. You are responsible for all applicable taxes.

13. Third-party services

The Service relies on and may link to third-party services we do not control, including Apple Maps (MapKit) for maps and park locations, Apple's WeatherKit for weather forecasts, and Apple's Push Notification service for alerts, and, if you use them, third-party sign-in providers such as Apple or Google. We are not responsible for these services, including their availability, content, accuracy, or privacy practices, and your use of them is at your own risk and subject to their terms. Any dealings you have with third parties through the Service are solely between you and the third party.

14. Our intellectual property

The Service, including its software, design, text, graphics, logos, and other content we provide (excluding User Content), is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use. Scout and our logos are our trademarks; you may not use them without our prior written permission. All rights not expressly granted are reserved.

15. Mobile application and Apple App Store terms

Your use of our mobile application may be subject to the terms of the app store from which you download it. If you obtained the application from the Apple App Store, the following additional terms apply, and you acknowledge and agree that:

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT, PARK INFORMATION, OR WEATHER FORECAST WILL BE ACCURATE OR RELIABLE. WE DO NOT MANAGE, OPERATE, OR INSPECT THE PARKS LISTED IN THE SERVICE, AND USE OF ANY PARK IS AT YOUR OWN AND YOUR DOG'S RISK. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCOUT A DOG PARK, LLC AND ITS OFFICERS, MEMBERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS (INCLUDING YOUR INTERACTIONS WITH OTHER USERS OR ANIMALS, YOUR TRAVEL TO OR FROM ANY LOCATION, AND THE CONDUCT OF ANY USER OR ANIMAL AT ANY LOCATION), WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION DO NOT APPLY TO LIABILITY ARISING FROM OUR GROSS NEGLIGENCE, FRAUD, OR INTENTIONAL OR RECKLESS MISCONDUCT.

18. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Scout a Dog Park, LLC and its officers, directors, members, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.

19. Termination

You may stop using the Service and delete your account at any time through your account settings or by contacting us at admin@scoutadogpark.com. We may suspend or terminate your access to the Service at any time, with or without notice, including if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases, and we may delete your account and content, subject to our Privacy Policy and applicable law. Provisions that by their nature should survive termination will survive, including ownership, licenses you granted, disclaimers, limitations of liability, indemnification, and dispute resolution.

20. Dispute resolution; arbitration and class action waiver

Informal resolution first. Before starting an arbitration, you agree to contact us at admin@scoutadogpark.com and try to resolve the dispute informally for at least 60 days.

Binding arbitration. If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration in New York, NY. The arbitration will proceed in accordance with JAMS under its applicable consumer arbitration rules, rather than in court, except as noted below. The Federal Arbitration Act governs this agreement.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive or equitable relief in court to protect intellectual property rights.

Class action waiver. You and we agree that each may bring claims only on an individual basis, and not as a plaintiff or class member in any class, consolidated, or representative action.

Opt-out. You may opt out of this arbitration agreement by sending written notice to admin@scoutadogpark.com within 30 days of first accepting these Terms, stating your name, the email or phone number associated with your account, and that you want to opt out.

21. Governing law and venue

These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-laws rules. To the extent any dispute is not subject to arbitration, you and we submit to the exclusive jurisdiction of the state and federal courts located in New York, New York.

22. General

These Terms, together with the Privacy Policy and any Additional Terms, are the entire agreement between you and us regarding the Service and supersede any prior agreements. Our failure to enforce any provision is not a waiver. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the rest will remain in effect. You may not assign these Terms without our consent; we may assign them freely. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us. We will not be liable for any delay or failure to perform due to causes beyond our reasonable control. Any claim arising out of or relating to the Service or these Terms must be brought within one (1) year after it arises, or it is permanently barred, to the extent permitted by law. We may provide notices to you through the Service, by email, or by other reasonable means.
